A will is a legal document that contains a declaration stating how to distribute a person’s possessions after his death. It declares who should own belongings and assets after death of the testator, i.e. the person whose will is being drafted. Using will writing services is a safe and secure way of ensuring stability of loved ones after death.

It is possible to self-draft a will in front of adult witnesses. However, this is not recommended, as it may not be considered legal in several states. Will writing services are an easy and legal option. If no will is present, the government is entitled with the decision of property distribution. This could result in personal property being declared as state property.

Hovercraft Regulations

Posted on January 30, 2008 - Filed Under Legal and Law | Leave a Comment

Hovercraft are largely regulated according to the environment they operate in. For example, a hovercraft operating over land is considered an off-road vehicle.

Over water, your craft will be considered to be a boat.

Most vehicles are required to be insured (whether as a boat or an off-road vehicle, or both). Here, we will briefly address these three issues.

Land Operation

Usually off-road vehicles cannot be operated on public roadways. In certain municipalities, some regulations for ATVs apply.

The ATV operating restrictions and equipment requirements may also apply to hovercraft depending on local area legislation. You may need headlights (and sometimes tail lights) to operate near public roadways (or after dark).

Errors During Surgery Frequent Medical Malpractice

Posted on January 30, 2008 - Filed Under Legal and Law | Leave a Comment

Each year in the United States, the number of mistakes make by medical professionals during surgery is alarmingly high. Sadly, many, if not all, of these surgical errors could have been avoided. Some surgical mistakes are just outrageous to even believe, such as performing surgery at the wrong site (wrong leg, arm etc.) or, worse, amputating the wrong limb altogether, which does actually happen.

When we enter an operating room as a patient, our lives are in the hands of the surgeon and the operating room team, and we trust them to perform our surgery without making errors, especially ones as egregious as operating on the wrong limb or removing the wrong part/area of the body.

When Do Independent Contractors Own A Copyright On Their Work?

Posted on January 29, 2008 - Filed Under Legal and Law | Leave a Comment

Recently, several different potential copyright clients inquiring whether they had a case for intentional copyright violation of their work have approached me. They all had similar stories. They worked as volunteers, interns or independent contractors for various companies. While working with those companies, they each created an original work in a tangible medium. They were not paid for their work, but rather were promised some sort of credit for their work, either in the form of college credits, or promotion of their name with the work. In each case, the other party did not deliver the promised consideration. As such, the potential client’s believed they had a copyright on the work they created, and further believed they could sue for copyright violation.

Posted on January 29, 2008 - Filed Under Legal and Law | Leave a Comment

On December 1, 2006, many amendments to the Federal Rules of Civil Procedure went into effect. There are three rules specifically that impact Computer Forensics and E-Discovery which need to be considered when building a case for your client, as well as protecting your client’s rights.

Most companies fail to realize the following two points:

  • Any data that can be compiled into viewable form, whether presented electronically or printed on paper, is potentially within the definition of “document”.

  • Electronic documents may be considered obsolete by the business in terms of its current computer infrastructure, but may have archival value and be recoverable to a readable format by specialized forensic techniques.

Michigan Real Estate Lawyers

Real estate refers to land, whether it is used for residential, industrial or commercial purposes. Real estate has become a hot topic in Michigan after the state legislature amended the constitution to prohibit eminent domain seizures of property from private owners solely for the purpose of transferring it to other private owners for economic development or to increase tax revenues. This negated an earlier court ruling.

The Priority Of Online Mortgages

Posted on January 29, 2008 - Filed Under Legal and Law | Leave a Comment

Mortgages first appeared in the English feudal system and have continually served as a means to obtain land ownership without paying for the total price of the land. The mortgage is essentially a contractual relationship creating an interest in land, but it is not a loan as many people often confuse it. Most mortgage agreements involve a promise to repay a debt, but is not a debt in itself, but rather, is evidence of a debt. Essentially, the mortgage is a transfer of either a legal or equitable interest in the land on the condition that the interest will be returned when the terms of the contract are performed. If the borrower fulfills all of the obligations of the mortgage contract, the transfer then becomes void and title automatically passes back to the mortgagor.

Protecting The Public

If there is any single issue about which all Americans are concerned about is public safety. Any injury caused intentionally or due to negligence is a threat to public safety. Gang crime, drug abuse, drunken driving, extortion and any other form of crime, all are cause of concern for public safety.

In recent times the worst form of concern for public safety has been international terrorism. Terrorists devise new methods and ways of destructing public life and property. They even put up unreasonable and unacceptable demands before the competent authorities and dare to sacrifice their lives for the wrong reasons while committing crimes.
